Hi! I am thrilled to announce that I will ride with Bike NCSY this August! This is much more than just exercise (which is a bonus!). Riding with Bike NCSY allows me the opportunity to raise money for some of NCSY’s incredible causes. NCSY is the premier organization dedicated to connect, inspire and empower Jewish teens, while actively working to encourage passionate Judaism through Torah and Tradition. NCSY provides many opportunities for high school teens, including after school learning programs, weekend Shabbatons, and leadership development initiatives. Bike NCSY enables hundreds of NCSY teens to continue on to the next stage of their Jewish journey, whether it’s on a Gap Year program learning Torah in Israel, taking a lead role in Jewish programs on their college campus, or beyond. Your partnership will help us enable Jewish teens from across North America to experience Torah and Judaism in a way they never thought possible. This waiver must be read and agreed to in order to register and participate in Bike NCSY.

In consideration of the acceptance by the Union of Orthodox Jewish Congregations of American (the “Orthodox Union”) and NCSY of my application to participate in Bike NCSY (the “Tour”), I hereby agree to the following:

Risks Involved in Participation: I hereby acknowledge, understand, and agree that the Tour contains risks, including but not limited to the risks of falling, collision with other bicyclists, bicycles, motor vehicles, pedestrians or stationary or moving objects, surface hazards, including pot holes and gratings, the conditions of the road, equipment failure, inadequate or misused safety equipment, the use of equipment provided by the tour or others, weather conditions, my own negligence and the negligence of others. My participation in the Tour is voluntary and done at my own risk. I voluntarily assume all risks of loss, damage, death or injury that I may sustain while participating in the Tour. I attest that I am sufficiently trained for participation and completion of the Tour. I recognize that an event of this nature can be physically demanding. I acknowledge the Tour’s recommendation that I consult with a physician regarding the advisability of my participation in this activity. I understand that serious accidents occasionally occur during the Tour, and that participants in this event may sustain mortal or serious injury as a consequence thereof. Nevertheless, I hereby agree to assume these risks.

Equipment and Helmets: I hereby acknowledge, understand, and agree that I am responsible for providing a bicycle for use in the Tour and for ensuring that such bicycle is in a good mechanical condition. I attest that the bicycle and any other equipment that I will use in the Tour are in good mechanical condition. I understand that bicycle helmets may (but do not always) prevent serious injury, and I hereby agree to wear one while participating in the tour.

Release and Waiver: I hereby expressly and unconditionally RELEASE, WAIVE and AGREE NOT TO SUE Bike NCSY, the Orthodox Union and/or NCSY and all other sponsoring or participating entities, governmental agencies, businesses and organizations, and their respective subsidiaries, affiliates, parent companies, and all past and present directors, trustees, officers, employees, agents, volunteers, contractors and representatives of the foregoing (collectively, “Releasees”, each individually, “Releasee”), from all liability and all claims of any kind – including but not limited to for damages, death, personal injury or loss of property – resulting from, arising out of or connected in any way with my participation in the Tour, WHETHER CAUSED BY NEGLIGENCE OF THE RELEASEES OR OTHERS, to the maximum extent permitted by law. In addition, I waive my insurers’ right to make a claim against Releasees based on payments by insurers to me or on my behalf for any reason. I acknowledge this means my insurers have no rights of subrogation against the Releasees. I will not initiate, participate in or assist anyone in connection with, any claim, lawsuit, court action or other legal proceeding or demand, whether currently known or unknown, whether anticipated or unanticipated, against Releasees, in connection with the Tour, and I waive any right I may have to do so.

Indemnification: Without limiting the effectiveness in any way of the release, waiver and covenant not to sue provided in this Waiver and Release, I will indemnify, hold harmless and reimburse Releasees from and for all damages, losses, costs or expenses (including legal fees) incurred or paid by Releasees to any person (including me or my insurers) in respect of any accident, injury (including death), loss or property damage, however caused, resulting from, arising out of or otherwise in connection with my participation in the Tour.

Medical Treatment and Records: I understand and agree that medical or other services rendered to me by or at the insistence or recommendation of Bike NCSY or any of the Releasees is not an admission of liability or an agreement to provide or to continue any such services, and is not a waiver by any Releasee of any right hereunder. I hereby consent to emergency medical treatment and transportation as medical professionals may deem appropriate in the event I suffer an injury arising out of my participation in the Tour. This Waiver and Release extends to any liability arising out of or in any way connected with the medical treatment or transportation provided in the event of such injury. If I am injured, I acknowledge and agree that I am responsible for my own medical expenses.

The Rules of the Tour: I agree to comply with the rules of the Tour as established by Bike NCSY or other officials present at the Tour, and to obey the directions of the officials. I agree to ride only on Bike NCSY approved routes while participating in the ride course portion of the Bike NCSY event. I agree that, to the fullest extent permitted by applicable law, the payment submitted in connection with my application for participation in the event is not refundable, deferrable or transferable under any circumstances, including cancellation of the event. I understand and agree that the Orthodox Union and NCSY reserves the right to reject any entry and to disqualify, bar or remove any individual from the Tour. Reasons for this action may include but are not limited to: violation of the rules of the Tour, unsafe conduct, abusive behavior, non-payment of Tour fees, participating without an official vest rider bib or bike plate, participating with an official vest rider bib or bike plate assigned to another person, transferring or attempting to transfer an official rider bib or bike plate to, or to obtain such items from another person, and providing false information on the Tour entry form(s) or to the Tour at any time including during the registration process. I understand that individuals disqualified from the Tour may be barred from future Tours.

Severability: Should any portion of this Waiver and Release be judicially determined to be invalid, voidable or unenforceable for any reason, such portion shall be severable from the remaining portions and the invalidity, voidability or unenforceability thereof shall not affect the validity, effect, enforceability or the interpretation of the remaining provisions. Headings in this Waiver and Release shall not limit the meaning of any provision.

Consent: I hereby consent to this Waiver and Release and acknowledge and agree that its terms shall likewise bind me, my heirs, executors, administrators, legal representatives and assignees. I understand that this is an important legal document in which I give up legal rights and remedies I would otherwise have and that this document applies to all activities at the Tour, regardless of whether specifically listed above or not. I hereby state that I am authorized to make this decision and I have read and understand this document.

From time to time, NCSY, and its affiliates, employees and agents (together, “NCSY”) take photographs and videos of individuals, including minors, who attend NCSY events, programs, and other offerings. NCSY engages in these activities for purposes relating to the advancement of the religious, spiritual, charitable, and educational goals and objectives of NCSY, including but not limited to the sharing of photos/videos in newsletters, on our blogs, and on our website and social media pages for the purpose of keeping our members and others informed of NCSY’s events and other activities. Please complete this form to give us permission to take photos/videos of you and/or your children when you participate in NCSY events and to use those photos/videos in our printed and online publicity:

1. I hereby authorize NCSY to take photographs and/or video of me (or my children) when I (or my children) participate at NCSY events. I grant NCSY full rights to use and share the images resulting from the photographs and/or videos and any reproductions thereof (the “Recording”), in whole or in part, along with my (or my children’s) name, biographical information and quotations for any purpose including fundraising, publicity, advertising, or on social media, all without further obligation or compensation. I hereby waive any right of review or approval regarding the Recording and NCSY shall have the right to edit or delete the Recording in its sole discretion. I understand that all rights in and to the Recording shall be NCSY’s sole and absolute property. I understand that if I access NCSY’s services through a third party platform, product, service, or application (a “Third Party Service”), content and related information generated while accessing NCSY’s services in this manner may be monitored, captured, and or recorded by the third parties that provide such Third Party Services. I consent to the use and sharing of personal information by any such third party as described in the privacy policy available through the Third Party Service. I release and forever discharge NCSY from all causes of action, suits, or liability of any kind arising from or in connection with the use or publication of any Recording of me or my children made in connection with my participation in NCSY events. I waive any right of privacy associated with the Recording and I waive any right to compensation related to the use of the Recording.

2. I HAVE READ THIS AGREEMENT AND AM FULLY AWARE OF ITS CONTENTS, INCLUDING THE RELEASE THAT I HAVE AGREED TO HEREIN.

3. I warrant that I am at least eighteen years of age (or, if not, that my parent or legal guardian has agreed to the foregoing and signed below) and that I have the full and unrestricted authority to enter into a contract for myself (or, if not, that my parent or legal guardian has agreed to the foregoing and signed below).

4. If any provision of this agreement is held to be unenforceable, the remainder of it shall continue to be in full force and effect.

5. This waiver shall remain in effect until such time as I advise NCSY otherwise in writing.

ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNIFICATION AGREEMENT RELATING TO CORONAVIRUS/COVID-19 (“Waiver”)

In consideration of the right for me, my minor child(ren), and/or my guardianee to participate in Union of Orthodox Jewish Congregations of America (the “Orthodox Union”) programs or events, including, without limitation, social gatherings, trips, Shabbatons, sports and physical activities, and programs and activities of Project Community (collectively, the “Events”) I hereby acknowledge and agree as follows, on behalf of myself, my minor child(ren), and/or my guardianee for whom I have the capacity to contract:

The novel coronavirus, (“COVID-19”), has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact, or by contact with contaminated surfaces and objects, and by airborne transmittal. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown. There is no known treatment or cure for Covid-19. The U.S. Food and Drug Administration has recently issued emergency use authorizations for three vaccines for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.
The Orthodox Union cannot prevent me, my child[ren] and/or my guardianee from becoming exposed to, contracting, or spreading COVID-19 while attending the Events or traveling to or from the Events. It is not possible to prevent against the presence of the disease. Therefore, I, my child[ren] and/or my guardianee may be exposed to and/or increase my/our risk of contracting or spreading COVID-19 by attending the Events, including risk of exposure to members of my/our household, or others.
Notwithstanding the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to participate in the Events. If signing this Waiver on behalf of my minor child(ren) and/or guardianee, I hereby willingly permit my minor child(ren) and/or guardianee to participant in the Events.
ASSUMPTION OF THE RISK. I understand and assume the risk of my, or my minor child(ren) and/or guardianee, becoming exposed to or infected by Covid-19 at the Events and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by Covid-19 may be the result of the actions, omissions or negligence of myself, my minor child(ren), and/or my guardianee and others, including, but not limited to Orthodox Union employees, agents, representatives, volunteers and program participants and their families, and I voluntarily assume all such risks on behalf of myself, my minor child(ren), and/or my guardianee for whom I have the capacity to contract.
WAIVER OF LAWSUIT/LIABILITY. By signing this Waiver, I hereby RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS AND COVENANT NOT TO SUE, (on behalf of myself, my minor child(ren), and/or my guardianee for whom I have the capacity to contract), the Orthodox Union, and their current or former respective officers, directors, trustees, affiliates, agents, employees, independent contractors, consultants, advisors, vendors, volunteers, licensees and assignees (collectively “Releasees” and each a “Releasee”) from any and all liability related to Covid-19 exposure or infection (or any illness or condition related thereto) which might occur as a result of me, my minor child(ren), and/or my guardianee participating in the Events. I understand and agree that this release means that I give up my right (on behalf of myself, my minor child(ren), and/or my guardianee for whom I have the capacity to contract) to bring any claims, including claims for personal injuries, death, disease, property loss, or any other losses, based on the negligence (active or passive) of the Orthodox Union, and its current or former employees, agents, representatives, volunteers, and program participants and their families, whether a Covid-19 infection occurs before, during or after participation in any of the Events.
INDEMNIFICIATION. By signing this Waiver, I hereby agree to defend, indemnify, and hold harmless (on behalf of myself, my minor child(ren), and/or my guardianee for whom I have the capacity to contract) the Releasees from and against any and all claims, demands, suits, judgments, losses, expenses, damage, liability and/or responsibility, including, without limitation, reasonable attorneys’ fees and costs, arising from or out of, or relating to, directly or indirectly, Covid-19 exposure, infection, or spread (or any illness or condition related thereto) which might occur as a result of me, my minor child(ren), and/or my guardianee participating in the Events, to the maximum extent permitted by applicable law.
CHOICE OF LAW. I understand and agree that this Waiver shall be construed and interpreted in accordance with the laws of the state where the Events took place, without regard to conflict of law principles of any jurisdiction.
ARBITRATION: I hereby agree (on behalf of myself, my minor child(ren), and/or my guardianee for whom I have the capacity to contract) to submit to arbitration any and all claims or disputes arising out of, covered by or in any manner related to this Waiver. Such arbitration shall be conducted, at my option, by (i) the Vaad Hadin V’Horaah, Rabbinical Court in New City, New York, or (ii) the Beth Din of the Chicago Rabbinical Council in Chicago, Illinois, or (iii) the Beth Din of the Rabbinical Council of California in Los Angeles (referred to collectively as the “Rabbinical Beth Din”), including any claims or disputes as to whether any claim or dispute is subject to arbitration under this Section. I agree (on behalf of myself, my minor child(ren), and/or my guardianee for whom I have the capacity to contract) to accept the ruling and award of the Rabbinical Beth Din as a final, binding, non-appealable, and legally enforceable decision, and that judgment may be entered on the award in any court of competent jurisdiction. I understand and agree that the Rabbinical Beth Din shall be obliged to give full effect to the terms of this Waiver. If any claim is found not to be subject to arbitration under this Waiver, I hereby waive any right I might have to a jury trial, and agree that any such claim shall be subject to a non-jury trial exclusively in the federal or state court in the state where the Events took place.
SEVERABILITY. If any provision of this Waiver is held by the Rabbinical Beth Din or a court to be invalid, void, or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired or invalidated.
ENTIRE AGREEMENT. This Waiver contains and constitutes the entire understanding and agreement amongst the Parties and cancels and supersedes all prior or contemporaneous oral or written understandings, negotiations, agreements, commitments, warranties, representations, and promises in connection herewith. No promise (whether orally or in writing or otherwise), understanding, representation, inducement, condition or warranty not set forth herein has been made or relied on by any party hereto.
BINDING EFFECT. By signing this Waiver, I agree that the terms of this Waiver will likewise bind me, my minor child(ren) and/or my guardianee, my heirs, legal representatives, and assignees.

I HAVE CAREFULLY READ AND VOLUNTARILY SIGN THIS WAIVER. I REPRESENT THAT I HAVE THE AUTHORITY TO DO SO ON BEHALF OF MYSELF, MY MINOR CHILD(REN), AND/OR guardianee.

I AM AWARE THAT BY SIGNING THIS WAIVER, I AM GIVING UP VALUABLE LEGAL RIGHTS, ON BEHALF OF MYSELF, MY MINOR CHILD(REN), AND/OR GUARDIANEE, INCLUDING THE RIGHT TO SUE, THE RIGHT TO A JURY TRIAL, AND THE RIGHT TO RECOVER DAMAGES FROM THE ORTHODOX UNION RESULTING FROM COVID-19 EXPOSURE OR INFECTION (OR ANY ILLNESS OR CONDITION RELATED THERETO) AS A RESULT OF PARTICIPATING IN THE EVENTS.

This Waiver shall remain in effect until such time as I advise you otherwise in writing.

I acknowledge and represent that I am at least eighteen (18) years of age and that I have read the foregoing ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNFICATION AGREEMENT RELATING TO CORONAVIRUS/COVID-19, and that I understand it and sign it voluntarily.
